9. How to request access to a record
- Complete Form 2 (Request for Access to Record) from the PAIA Regulations, 2021. It is available from the Information Regulator’s website or from us on request.
- Submit it to the Information Officer by email, by hand or by post, using the details in section 3.
- Give enough detail to identify the record and yourself. State the right you want to exercise or protect, and why the record is needed for it.
- If you are requesting on behalf of someone else, include proof of your authority.
- If you can’t read or write, or have a disability, you may make the request orally. The Information Officer will complete the form for you and give you a copy.
- Pay the request fee if one applies (see section 10). Your request is processed once it is paid.
Timelines:
– We will decide on a request within 30 days of receiving it.
– We may extend this once by up to a further 30 days in the circumstances PAIA allows, and we will tell you in writing if we do.
– If we do not decide within the time allowed, the request is treated as refused.
Requests for your own personal information:
– There is no request fee when you ask for your own personal information.
– You may also simply email support@tekari.co.za under POPIA section 23.
10. Fees
Fees are set out in the PAIA Regulations, 2021 (Annexure B, private bodies). They may include:
- a request fee, payable before the request is processed (not payable for your own personal information)
- an access fee, for searching, preparing and reproducing the record, and for postage where applicable
- a deposit, if preparing the record will take longer than the time set in the Regulations
The Information Officer will tell you which fees apply, and the amounts, on Form 3 before any work is done.
11. Grounds for refusal
Tekari may or must refuse access on the grounds in Chapter 4 of Part 3 of PAIA, including to protect:
- the privacy of a third party who is a natural person (section 63)
- third parties’ commercial information (section 64)
- confidential information of third parties (section 65)
- the safety of individuals and property (section 66)
- records privileged from production in legal proceedings (section 67)
- Tekari’s own commercial information, such as trade secrets, financial, commercial or technical information, and information that could put us at a disadvantage in negotiations or competition (section 68)
- research information (section 69)
A record must still be disclosed where it would reveal a serious contravention of the law, or an imminent and serious public safety or environmental risk, and the public interest clearly outweighs the harm (section 70).
12. Remedies
Tekari has no internal appeal procedure. If you are unhappy with a decision (a refusal, the fees, or an extension), you may:
- lodge a complaint with the Information Regulator within 180 days of the decision, using Form 5 from the Regulator’s website (PAIAComplaints@inforegulator.org.za); or
- apply to a court for relief within 180 days.
13. Availability and updates
This manual is reviewed at least once a year and whenever our details or processing change. The latest version is always at https://tekari.co.za/paia-manual/.
